PLEASE READ THE FOLLOWING TERMS AND CONDITIONS OF USE CAREFULLY BEFORE USING THIS WEBSITE.
All users of this site agree that access to and use of this site are subject to the following terms and conditions and other applicable law.
If you do not agree to these terms and conditions, please do not use this site.
GENERAL TERMS AND CONDITIONS OF SALE
Limitations of Liability
In no event shall scottlift.ca be liable for any indirect, special, incidental or consequential damages including but not limited to loss of use, loss of data, loss of business or profits. Some provinces or states do not allow the exclusion or limitation of incidental or consequential damages, so the above limitation or exclusion may not apply to you.
Prices
Prices are subject to change without notice. scottlift.ca is not responsible for typographical errors.
Warranty Limitations
Except as specifically set forth therein, scottlift.ca makes no warranties, express or implied, and disclaims all other warranties, including without limitation implied warranties of merchantability, fitness for a particular purpose, and conformity to models or samples. Some provinces and provinces or states do not allow limitations on implied warranties so these limitations might not apply to you. The warranties set forth herein give you specific legal rights and you may have other rights that vary from province to province or state to state. Manufacturers' warranties for exported products may vary or may be null and void for products exported outside Canada.
Payment Terms
Terms of payment are within scottlift.ca’s sole discretion, and unless otherwise agreed to by scottlift.ca, payment must be received by scottlift.ca prior to scottlift.ca acceptance of an order. Payment for the products will be made by credit card, wire transfer, or some other prearranged payment method unless credit terms have been agreed to by scottlift.ca. Invoices are due and payable within the time period noted on the invoice, measured from the date of the invoice. scottlift.ca may invoice parts of an order separately. Orders are not binding upon scottlift.ca until accepted by scottlift.ca. Any quotations given by scottlift.ca will be valid for the period stated on the quotation. Customer agrees to pay interest on all past-due sums at the highest rate allowed by law.
Shipping Charges/Taxes/Delivery
Separate charges for shipping and handling will be shown on scottlift.ca’s invoice(s). You are responsible for all applicable sales and other taxes associated with the order. If applicable, a separate charge for taxes will be shown on scottlift.ca’s invoice. scottlift.ca will not be responsible for delays in delivery due to events beyond its control, including shortage of materials, labor strikes, transportation failures or acts of God.

All Supplier Direct orders over $750 in net value will be shipped and invoiced with surface freight prepaid using the Suppliers choice of carrier. Prepaid orders apply to stock products only and do not include the following, for freight on these items please refer to point 4.

All Supplier Direct orders under $750 in net value, shipped by surface Courier will be invoiced as follows: |

Supplier Direct will ship the following special commodity products surface freight prepaid and no charge using Suppliers choice of carrier with the parameters noted below. Any shipments outside of these parameters will be charged at freight and handling charges noted above.
* All related Costs and Freight on Drop Ship orders from vendors will be the customer's responsibility. |

Supplier Direct GROUND BACKORDERS will be shipped freight prepaid using Suppliers choice of carrier. Customers are responsible for any related freight charges on orders that you choose to ship from the warehouse that is not determined as your default warehouse. |
AIR FREIGHT CHARGES:

Supplier Direct Air shipments will be charged freight at the applicable rates related to the weight and destination. |

Supplier Direct Air Backorder shipments will be charged freight at the applicable rates related to the weight and destination. Customers must notify inside sales if they want related backorders shipped ground, ground backorder policy applies. |

Supplier Direct Air Shipments will be shipped freight prepaid using Suppliers choice of carrier. Customers are responsible for any related freight charges on orders that you choose to ship from the warehouse that is not determined as your default warehouse. |
** Please note due to policies now practiced by freight carriers and couriers all freight charges will be calculated utilizing DIMENSIONAL WEIGHT or actual weight whichever is the higher of the two, determined by the freight carriers and couriers.**
Title/Risk of Loss
When purchasing items from the site, title to products and risk of loss passes from scottlift.ca to you upon delivery to the carrier.
Components
Unless you are purchasing a remanufactured or reclaimed product, the product you purchase contains components that are new or equivalent to new in accordance with industry standards.
Once you place an order for special order items, your order is considered non-cancelable and any special order items purchased by you are also non-returnable.
General Returns: All returns must be requested within 90 days of invoice. Returned merchandise will ONLY be accepted with an issued Return-Authorization number and ONLY within 30 days of issuing of that Return-Authorization number. All Special Order products, paints, chemicals, lubricants, LPG tanks, and fire extinguishers are non-returnable once ordered. Returned items must be returned to scottlift.ca with freight prepaid.
All returns, except for returns involving an scottlift.ca order or product error, will be subject to a 25% restocking charge per line item.
Merchandise returned as defective will be thoroughly tested and inspected. For merchandise that is verified as defective, scottlift.ca will either (at its sole discretion) repair or replace the merchandise at no charge, or issue a full credit for the defective merchandise, including freight. Merchandise that is returned as defective, but that is determined to work properly, will be subject to a testing fee and the 25% restocking charge per line item.
Credit will not be issued for merchandise damaged due to corrosive materials, abuse, alteration, or misuse.
Before returning any merchandise to scottlift.ca, a Return Authorization Number must be obtained from scottlift.ca. Your request must include:
- Part Number & Description
- Return Reason
- scottlift.ca Invoice Number
- Customer's P.O. Number
Core Charges: Core credits will be voided if cores are not returned to scottlift.ca within 90 days.
Cores may have deductions for the following reasons:
- Core has been disassembled
- Missing parts
- Bad or unserviceable non-standard replacement components
- If Cores are not of the same configuration as remanufactured unit supplied
Cores must be returned in the same container that the remanufactured unit was shipped in or be subject to a $100.00 charge. Returned items must be returned to scottlift.ca with freight prepaid.
Amendments/Applicable Law
These terms and conditions may be amended at any time by scottlift.ca The laws of the province of Ontario shall govern these Terms and Conditions.

Typographical Errors
In the event that a scottlift.ca product is mistakenly listed at an incorrect price, scottlift.ca reserves the right to refuse or cancel any orders placed for product listed at the incorrect price. scottlift.ca reserves the right to refuse or cancel any such orders whether or not the order has been confirmed and your credit card charged. If your credit card has already been charged for the purchase and your order is cancelled, scottlift.ca shall issue a credit to your credit card account in the amount of the incorrect price.
Term; Termination
These terms and conditions are applicable to you upon your accessing the site and/or completing the registration or shopping process. These terms and conditions, or any part of them, may be terminated by scottlift.ca without notice at any time, for any reason. The provisions relating to Copyrights, Trademark, Disclaimer, Limitation of Liability, Indemnification and Miscellaneous, shall survive any termination.

Miscellaneous
Your use of this site shall be governed in all respects by the laws of the province of Ontario, Canada, without regard to choice of law provisions, and not by the 1980 U.N. Convention on contracts for the international sale of goods. You agree that jurisdiction over and venue in any legal proceeding directly or indirectly arising out of or relating to this site (including but not limited to the purchase of scottlift.ca products) shall be in the provincial or federal courts located in Simcoe County, Ontario. Any cause of action or claim you may have with respect to the site (including but not limited to the purchase of scottlift.ca products) must be commenced within one (1) year after the claim or cause of action arises. scottlift.ca's failure to insist upon or enforce strict performance of any provision of these terms and conditions shall not be construed as a waiver of any provision or right. Use of Site
